What are the three types of delegated legislation?
The three types of delegated legislation are Orders in Council, Statutory Instruments, and By-laws.
What are Orders in Council?
Orders in Council are made by the Prime Minister and government members to bring Acts of Parliament into force, transfer responsibilities, and make laws in emergencies.
Example: The Misuse of Drugs Act 1971 was amended in 2008 to change cannabis from class C to class B.
What are Statutory Instruments?
Statutory Instruments are rules and regulations made by Government Ministers under the authority of an Enabling/Parent Act, with about 3,000 enacted each year.
Example: The Coronavirus Act 2020 led to rules regarding local lockdowns.
What are By-laws?
By-laws are laws made by local authorities under the Local Government Act 1972, affecting matters within their area, such as traffic control and public behavior.
Example: Manchester City Council has made by-laws for parking restrictions.
