RECKLESSNESS
Recklessness is established if:
The defendant recognised that there was a real possibility that:
- his actions would bring about the proscribed result and/or
-that the proscribed circumstances existed and
- having regard to that risk those actions were unreasonable
GRIEVOUS BODILY HARM
Grievous bodily harm can be defined simply as ‘harm that is really serious’
INJURE
To cause ‘actual bodily harm’
DELIBERATE ACT
Must be more than involuntary or accidental
ACTUAL BODILY HARM
May be internal or external and need not be permanent or dangerous
FACILITATE
To make possible or make easy/easier
BY ANY VIOLENT MEANS RENDERS ANY PERSON INCAPABLE OF RESISTANCE
‘Violent means’ includes the application of force that physically incapacitates a person such as tying the victims hands and feet
