dealing with offending behaviour : restorative justice Flashcards
restorative justice
offender reconciles with the victim of their crime so they see the impact of their crime
roles in restorative justice
offender = encouraged to take responsibility
victims = active role and explain the effects of their crime
usually with custodial = reduction in sentencing
key features
-focus on acceptance of responsibility
-meet outside of court setting
-all parties
-focus on positive outcomes for both
sentencing and restitution
-if face to face not possible then offender may pay compensation
-match needs of survivor
strength
positive outcomes from 7 year study (shapland)
-85% survivors report satisfaction
-78% would recommend = useful
-should want to take part in RJ for it to work
strength
RJ leads to reduction in recidivism (meta-analysis)
-compared to controls
-RJ less likely to re-offend (especially violent)
-violent is personal and burglary is not
weakness
factors
-expensive
-required skills
-trained professionals
-time consuming
-high drop-out rates
weakness
relies on intentions of offender
-may use RJ to get a reduction in sentencing or to meet survivors
-not honourable = abuse system
