What NFA ( no further actions) mean
After liasing with line manager and custody officer, you decide that you will not be able to reach the level of evidence required for a realistic prospect of conviction (RPOC) then the case should recive NFA
NFA - means that the case will be filed , however when new evidence arrive can be re opened again and suspect need to be aware of it .
What Bail mean
what types of bail we have
is a temporary release of accused person (suspect) that requires that person to surrender themselves to custody at an appointed time and date
conditional (custody oficer must record grounds on the custody record and suspect need to be informed and provided with copy) and unconditioal
ABP’s and authorisation periods
Initial bail period - 3 months (autorisation from custody sergeant)
First extention of bail 4-6 months ( authorisation from inspector 2 weeks before bail end date)
Second extension 7- 9 months ( autorisation from superintendat 2 weeks before bail end date)
s 37 (7) of PACE
bail specifically for a charging decision (custody officer’s bail) is used where the full code test is met and charging decision is being sought from CPS - this bail effectivley stops the approved bail periods.
Determining factors when deciding if pre-charged bail is necessary and proportionate
- secure offending bailed person surrenders to custody
- prevent offending by the bailed person
- safeguard victims of crime and witnesses
-safeguard the bailed person themselves - manage risk to the public
