Sources of Criminal Law
- Criminal Law is state responsibility (residual power)
- In Qld, main source of criminal law is the Criminal Code 1899
Rights and Responsibilities of Police, Suspects, Accused and Victims
- To investigate alleged crimes, police require special powers which give authorisation to go beyond what a normal person can do
- Searching of property
- Searching motor vehicles
- Taking DNA samples
- Carrying out forensic procedures
- Arresting and detaining persons
Just Outcome
Legally right, conforming with what is lawful or fair given the circumstances.
Equitable Outcome
Even and impartial; balance between the rule of law, and freedoms of individuals and society; impartial and fair outcome.
Presumption of Innocence
Innocent until proven guilty
Onus of Proof
Prosecution carries the onus of proof, they must prove in court that the accused did commit the crime.
Standard of Proof
Beyond reasonable doubt
Mens Rea
The person has to know what they are doing. They must have a sense of criminal responsibility or guilty mind.
Actus Rea
Physical act of committing an offence/crime.
Intent
The person has to have an intent to commit a crime.
