The two criminal justice models:
Due process and crime control
Model that tries to control and suppress crime; efficiency; “assembly line justice”; presumption of guilt
Crime control model
Model that tries to protect individuals against mistakes made by the police and prosecutors; slow and deliberate process
Due process model
Type of law: legally prohibited acts
Substantive law
What are the types of violent crimes?
Homicide, assault, sex crimes
What are the types of property crimes?
Robbery, burglary, larceny/theft
What are the types of public order crimes?
Drug crimes, prostitution, disorderly behavior, protesting
Type of law: includes the Bill of Rights and Amendments specifically focused on criminal justice
Procedural law
Amendment: prohibits unreasonable searches and seizures without a warrant
Fourth amendment
Amendment: all felony cases have the right to be indicted before a jury, double jeopardy, self-incrimination, due process
Fifth amendment
Amendment: right to counsel, speedy and public trial, fair/impartial jury, witnesses
Sixth amendment
Amendment: prohibits excessive fines or bail, prohibits cruel and unusual punishment
Eighth amendment
Amendment: extended due process to the states
Fourteenth amendment
What are some reasons why crime is declining?
Legalization of abortion, increased prison rates, economic expansion, better policing, changes in youth culture, immigration changes, urban development
