- chosen from ministers who give advice + adminster laws
- chosen by the chancellor
- formulates laws to the Reichstag

- voters cast for a party, not a person; parties get 1 seat for every 60,000 votes

- Article 48 says in an emergency can suspend the constitution (government) and pass laws by decree BUT these laws must be signed by the Chancellor + laws can be undone by the next Reichstag
