What is a Collateral Warranty?

A

A way of forming a direct contractual link between two parties which otherwise would not have a link e.g. subcontractor and client.

What is a third-party right?

A

They allow third party to be written into contract (third party act 1999) to give the third party the benefits of the contract.

When was NEC4 published? What are some of the fundamental changes between NEC3 and NEC4 contracts?

A

NEC4 contracts were published in June 2017. The key differences are

  1. terminology - such as Employer becomes client and work information become scope
  2. Programme accpetance/ rejection changes under clause 31.3. The new requirements provide treated acceptance of the programme in situations where the project manager does not respond.
  3. NEC4 has renamed the risk register to early warning register to help separate it from the risk register used as a wider project management tool.
