OT reporting time frames
Critical = 24hrs
Very urgent = 48hrs
Urgent = 7days
CP age reporting
The victim is under 18 at the time of complaint.
Must include sexual, physical abuse or serious neglect.
3 initial steps - Police and OT
1) Referral - share information between agencies.
2) Consultation
3) Agreement - agreeing on initial action in an IJIP
S195 - Ill treatment or neglect of a child
The offence applied to both those that have actual care or charge of the child and staff members of any hospital or resident where the child reside.
It also covers vulnerable adults.
S195A - Failure to protect a child
A child or vulnerable adult who is at risk of harm but no action is taken.
Applies to members of the same household and staff members of any hospital or residence where the victim resides.
Mens rea- knows the victim is at risk of death/GBH or sexual assault as a result of acts or omissions by another person.
Actua reus- fails to take reasonable steps to protect the victim from risk.
What’s is required to be proved:
-the victim is under 18 at the time of the offence.
-the defendant was over 18.
-the defendant had frequent contact with the victim (same household).
-the defendant had knowledges of the risk to the child.
Considerations when completing an IJIP
- Immediate safety of the child and other children who may be identified as at risk.
- If a joint visit is required.
- Management of the initial interview.
- Referral to a medical practitioner and authority to do so.
- Collection of physical evidence.
- Any further actions agreed for Police/ and OT.
Neglect
- Not providing adequate food, shelter or clothing.
- Not protecting a child from physical harm.
- Not accessing appropriate medical treatment or care.
- Allowing a child to be exposed to illicit drug manufacturing.
- Allowing a child to be exposed to an environment where volatile toxic or flammable chemicals have been used or stored.
Questioning a child
If a child has made a clear disclosure to an adult and that adult can give you the information then DO NOT ask the child again what happened.
If it is unclear what the child said and there are no urgent safety issues DO NOT question the child further.
If absolutely necessary to speak to ascertain safety, ask open ended questions.
DO NOT continue to question the child if it becomes clear while speaking to them that an offence has occurred.
Sexual
Sexual abuse- an indecent act, sexual violation or the use of a child making sexual imaging.
Physical
Physical abuse- actions of an offense that result in or could potentially result in physical harm or injury of a child.
Three areas to consider when determining if physical abuse meets the threshold-
- The action (of the abuse).
- blow to the head
- shaking of an infant
-strangulation
- attempted drowning
- use of an object as a weapon - The injury inflicted (outcome/result).
- a bone fracture
- burn
- loss of consciousness
- an injury that requires medical attention
- bruising or abrasions to an infant - The circumstances.
- more than one offender
- history of abuse
- a high degree of violence
- the offenders history
- the vulnerability of a child (under 5 years, disabled)
- location of the incident
- level of concern from the informant (witness/professional opinion)
