Copyright Act Introduction.
- Copyright is the set of exclusive rights granted to the author or creator of an original work, including the right to copy, distribute and adapt the work.
- Copyright Act, 1957, Copyright rules 1958, and International Copyright order, 1999 governs the copyright protection in India.
- The Indian Copyright Act, 1957 provides protection of rights to an author of literary, dramatic, musical, artistic, cinematographic film, or sound recordings. [LDMACS]
- In simple terms, it provides protection to people who create an original work and gives them certain rights and privileges.
S 2(d) Copy act
The Definition of an Author is provided under Section 2(d) of the Act. An Author means and includes the following:
(i) in relation to a literary or dramatic work, the author of the work;
(ii) in relation to a musical work, the composer;
(iii) in relation to an artistic work other than a photograph, the artist;
(iv) in relation to a photograph, the person taking the photograph;
(v) in relation to a cinematograph film or sound recording, the producer; and
(vi) in relation to any literary, dramatic, musical or artistic work which is computer-generated, the person who causes the work to be created.
Object of Copyright Act
Obj of Copyright act is to protect the author of a copyrighted work from an unlawful reproduction or exploitation of his work by others.
S 13 copyright Act
- Not each and every work is entitled to copyright protection.
- As per the said Section, copyright exists in original literary, dramatic, musical and artistic work + cinematograph films and sound recording.
S 14 Copyright Act explained
- Acc of S 14 Copyright Act, ‘copyright’ means the exclusive right subject to the provisions of this act, to do or authorise the doing of any of the following acts in respect of a work or any substantial part thereof, namely -
