What is a controlled delivery pursuant to section 12 of the misuse of drugs amendment act 1978?

A

A controlled delivery is when a consignment of illicit drugs are detected, the delivery of those drugs is then made under the control and surveillance of NZ customs and Police with a view to identify those involve and securing evidence.

A
  • a clean controlled delivery (no drugs left in the consignment) leads to charges of importation or conspiracy. Reduced risk.
  • leaving a small amount of drugs in the consignment. Potentially giving the options of possession of supply charge. Higher risks and requires greater security and recovery of the drugs after the termination of the operation.

  • assume ownership of the investigation and appoint roles.
  • liaise with customs OC exhibits.
  • consider electronic interception.
  • request customs to manipulate the track and trace system if the parcel is tracked.
  • contact Reds, photography section, the crime monitoring centre and technical support unit if applicable.
  • start planning the operation and rostering, there needs to be 24 hour coverage of the controlled delivery.
