What is a controlled delivery pursuant to section 12 of the misuse of drugs amendment act 1978?
A controlled delivery is when a consignment of illicit drugs are detected, the delivery of those drugs is then made under the control and surveillance of NZ customs and Police with a view to identify those involve and securing evidence.
Powers to undertake controlled deliveries during joint operations with between Police and Customs?
Are vested on a customs officer only under S12!of the misuse of drugs amendment act 1978.
Section 81 of S&S act 2012. Police powers to search persons, places and vehicles relating to deliveries.
Drug deliveries can occur in what situations?
- inside a mail article
- arriving courier hidden in body packing, in luggage or internal concealment.
- within air freight.
- within sea freight.
- transiting through NZ to another final destination.
- arriving on a commercial vessel picking up/ dropping off cargo before continuing to another destination.
The two controlled deliveries options are?
- a clean controlled delivery (no drugs left in the consignment) leads to charges of importation or conspiracy. Reduced risk.
- leaving a small amount of drugs in the consignment. Potentially giving the options of possession of supply charge. Higher risks and requires greater security and recovery of the drugs after the termination of the operation.
Controlled deliveries policy states?
To effect overt seizure rather than risk loss of control of the consignment, even if it means the seizure has to be made prematurely and alarming the offenders.
Initial action phase of controlled deliveries?
- assume ownership of the investigation and appoint roles.
- liaise with customs OC exhibits.
- consider electronic interception.
- request customs to manipulate the track and trace system if the parcel is tracked.
- contact Reds, photography section, the crime monitoring centre and technical support unit if applicable.
- start planning the operation and rostering, there needs to be 24 hour coverage of the controlled delivery.
Intel phase of a controlled delivery?
- profile package and sender details (DNA, finger prints, SIM information, phone numbers ect)
- profile delivery address (occupants, telecoms, CHIS info, photos, previous police reports/visits ect)
- profile the addressee (previous offences, bank accounts, travel history, family members and associations ect.)
Activities that require a surveilllance device warrant under section 46 of S & S act 2012?
- observation or recording of private activity on private property by means of a device.
- use of a tracking device, unless to confirm if something has been opened or tampered with.
- use of an interception device to intercept private communications.
- use of a device that involves trespass.
- observation of private activity on the curtilage of private property by means of a device for more that 3 hours in and 24 hours or 8 hours total.
Observation post (friendly address in the vacinity of the target address) considerations for controlled deliveries include?
- proximity to target address.
- unobstructed LOS.
- access to address for staff without a rousing suspicion.
- phone lines/ internet.
- any other consideration such as parking or schools ect.
Observation post occupants, things to consider?
- cover story.
- protection of the occupants identity.
- 24 access for staff.
- no visitors to the address during the op.
- preferable no children at the address
Delivery phase of a controlled delivery, things to consider?
- 24 hour coverage.
- method of delivery (delivered by postie or courier/ or officer posing as one)
- recording interaction between recipient and deliver.
- if the receiver is at the address or not.
- when to execute the arrest.
- if the package goes mobile, how will you control the risk.
- keep a log of all actions during this phase.
Tracking devices, two categories are?
- a device that can be used to ascertain the location of a thing.
- a device for detecting if a package has been handled or opened.
Section 46 of S&S act 2012 use of tracking devices limitations?
Surveillance Device warrant needed for the use of a tracking device excepted if it is installed for the purpose of of ascertaining whether a thing has been opened or handled and it doesn’t involve trespass.
