What kind of requirement is consent
Consent is a legal and ethical requirement. Touching a patient without consent could be viewed as physical or sexual assault. It is an ethical requirement that establishes trust.
Types of consent
Consent can be written (on a form) or oral (express consent). Implied consent is based on the patient complying with procedure.
How to ensure consent is legal
For consent to be legal the patient must have the capacity to consent, the patient must have all the necessary information, including the purpose and nature of the procedure. The consent must be voluntary and patients must be fully aware of their options and have the right to refuse. It is their choice.
