Legal aspect of consent
Everyone has the right to have their bodily integrity protected against invasion by others
What is Consent?
Legal and ethical requirement prior to a patient receiving any medical treatment or procedures
- Essentially the agreement of the patient to the treatment. Can be given orally or by signing a form
Ethical aspect of consent
Is a key test of the degree to which patient autonomy is respected
3 Elements to Consent
1) Informed
2) Competent
3) Voluntary
Informed aspect of consent
Patient should be fully informed about the treatment they are about to receive
Prudent professional standard: Dr decided what to tell and what not to tell patient
Prudent patient standard: Dr gives as much information as patient would like to know
(Risks, success rate, side effects, comparison to other treatment options)
Childhood consent
- At the age of 16 a child is considered an adult
- Under the age of 16, child may be deemed “Fraser Competent” which allows them the capacity to consent
