Define Search
An entry or intrusion by a government agent on a quest for evidence into an area where an individual has a reasonable expectation of privacy
Define Reasonable Suspicion
The belief by a reasonable and prudent person based on articulable facts that something has happened
Define Probable Cause
The level of suspicion that would cause a reasonable and prudent person, given the overall circumstances, to believe a crime has been committed
Define Private Space
Any space with a reasonable expectation of privacy/ any space that is not a common space
Two prong test for private space
- Is there a reasonable expectation or privacy
2. And is that expectation reasonable
Define Confined Space
Any space not designed for continuous human occupancy and have limited means of entry or exit and restricted ventilation (fuel tanks, sealed compartments, bilges)
Confined Space Policy
Boarding personnel must not enter any confined or enclosed spaces that are likely to have atmospheric hazards such as oxygen depletion, flammable gases or other toxic gases until they have been cleared
Characteristics of confined spaces
- large enough for a person to enter and preform work
- limited/restricted means for entry or exit
- is not designed for continuous human occupancy
Define Enclosed Space
Any space other than a confined space that is enclosed by bulkheads or over head
People who can deem a confined space clean
- Certified industrial hygienist
- Marine chemist
- Gas free engineer
- Competent person (defined by 29 CFR 1915.4)
Define ISS
The initial safety sweep is comducted to identify any safety hazards that may exist and ensure the seaworthiness of the vessel being boarded
When does a boarding team conduct an ISS
At the start of every boarding
What is the difference between an ISS and a search
An ISS is not an intrusion of an area or privacy, an ISS is a general check on a vessel looking for safety hazards while a search you would be looking for evidence
Define ESS
An ESS may be conducted only when reasonable suspicion exists that there is a particular hazard that may threaten the boarding team
What are you searching for during an ESS
- Safety Hazards (in the immediate area of the hazard)
- Unaccountable for personnel (all person sized spaces)
- Weapons (in the immediate area)
