What is conciliation?

A

Conciliation is a cooperative method of dispute resolution involving the assistance of an individual third party, with the aim of enabling the parties to reach a decision between them. The third part does not make the final decision, but listens to the facts and makes suggestions to assist the party, so that they come to a conclusion. Conciliatory have more outcome over a business, than a mediator.

A

All Victorian courts, under the civil procedures act, have the power to refer parties to conciliation, however courts generally use mediation. Conciliation is widely used in the family court of Victoria.

A

Parties may be required to participate in a conference to identify the nature of the issue in dispute, and to promote a settlement before a matter is heard in a tribunal. The conference is conducted using the conciliation process.
