What is the Data Protection Act 1998?
The act covers the personal data that is stored both on computers and organized paper filing systems.
What is included in personal data?
Data that can be used by itself, or in combination with more data, to identify a living person. This person would be called a ‘Data Subject’
What are the 8 rules that the Data Protection Act protects data by?
1.) Personal data shall be processed fairly and lawfully.
2.) Personal data shall be obtained only for one or more specified and lawful purpose.
3.) Personal data should be adequate, relevant and not excessive for its purpose(s).
4.) Personal data shall be accurate and where necessary kept up to date.
5.) Personal data shall not be kept for longer than is necessary for its purpose(s).
6.) Personal data shall be processed in aaccordance with the rights of data subjects under this Act.
7.) Appropriate technical and organisational measures shal be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.
8.) Personal data shll not be transferred to a country or territory outside the European Economic Area, unless that country or territory ensures an adequate level of data protection.
What rights does the Data Protection Act give to data subjects?
- The right to request a copy of the data held about them.
- The right to correct the data held about them.
- The right to prevent marketing using contact details provided by the data subject.
The Data Protection Act 1998 was replaced. When was it replaced and what was it replaced by?
It was replaced in 2018 by the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
What is the Computer Misuse Act 1990?
An act that concerns the malicious use of computers.
Why was the Computer Misuse Act originally created?
To ensure computer hacking was covered by the law.
How is the Computer Misuse Act kept relevant?
It has since been, and still is, updated frequently to remain relevant.
What are the three primary offences outlined in the Computer Misuse Act?
1.) Unauthorised access to computer materials.
2.) Unauthorised access with intent to commit further offences.
3.) Unauthorised modification to computer material.
What is the Copyrights, Design and Patents Act 1988?
An act brought in to protect people’s property online.
How is each offence punishable?
They are each punishable with imprisonment. Generally, the second and third offences have worse consequences compared to the first offence.
What does the Copyrights Act cover?
It covers everything from logos to music recordings
When does the Copyright Act automatically apply?
It is automatically applied if the work is original.
When does the copyright expire?
Depending on the type of work, the copyright doesn’t expire until 25-70 years after the creator’s death.
The Copyrights Act was extended in 1992 to include what?
It was extended to include computer programs as a work of literacy, meaning the copyright automatically applies to code.
