What does CAFRA regulate?
Development within the specified coastal zone:
- almost any activity on a beach or dune
- # of dwelling units
- # of commercial parking spaces
- public development
CAFRA non-regulated activities include….
- public recreation outside riparian buffer
- educational facilities
- hand-removal of debris along a watercourse
- open decks of residential structures that meet UCC
- Repair/maintenance/replacement of roads, bridges, culverts that will not affect flow/footprint
What is CAFRA Permit-by-Rule (PBR)?
22 permits for low-impact activities provided that all conditions are satisfied. No actual permit needed.
Where does CAFRA apply?
Within the specified CAFRA zone (not all tidally influenced waters)
- Middlesex to Salem County
What is a CAFRA General Permit?
32 permits for regulated activities that require explicit permission by NJDEP (i.e. new construction)
What is a CAFRA Individual Permit?
For activities that do not meet the requirements of PBR’s or General Permits.
When was CAFRA was passed?
1973, with a major expansion in 1993
Does CAFRA apply in areas regulated under the Wetlands Act of 1970?
No.
How does CAFRA interact with the SDRP?
Municipalities can become a Coastal Center through Plan Endorsement to relax impervious/vegetation requirements
