Section 61 Children (Scotland) Act 1995?
“Emergency Protection of Children where Child Protection Order is not available”.
Where a constable has reasonable cause to believe that :
a) the conditions for the making of a CPO laid down in Section 57 are satisfies;
b) that it’s not practicable in the circumstances for him to make an application for such an order to the sheriff or for the sheriff to consider such an application; and
c) that, in order to protect the child from significant harm or further such harm, it’s necessary to remove the child to a ‘place of safety’.
What crimes can you arrest a child for?
- Serious crimes
- Driving underage
Age of Criminal Responsibility in Scotland?
- 12 Years Old
- If a child under 12 breaks the law, their case won’t go to criminal court but a “Children’s Hearing”.
- Children aged 12 - 16 can go to court but only for serious crimes. For most offences they will get an early intervention, such as a warning, help from a support organisation or going to a “Children’s Hearing”.
Section 12 Children and Young Person (Scotland) Act 1937?
It’s an offence for any person aged 16 or over who has parental responsibilities, charge or care of a child or young persons under 16 and wilfully ill-treats, neglects, abandons or exposes him/her likely to cause unnecessary suffering or injury to health.
Section 83 Children (Scotland) Act 1995?
It’s an offence for anyone knowingly to assist or induce a child to abscond, attempt to induce a child to abscond, harbour or conceal a child who has abandoned or prevent a child from returning to a ‘place of safety’, or to a relevant place/person conveying them to a ‘place of safety’.
