Aggravated DUI
- DUI causing personal injury, dealth
- DUI with a prior conviction of reckless homocide/ aggravated DUI
- 3rd or subsequent DUI conviction
- DUI without a valid license, permit, vehicle insurance
- DUI while driving school bus with children onboard
Revocation - the indefinite withdrawal of driving privileges by the Secretary of State’s office
To regain yoru driving privileges, you may be eligible to reapply for a license after a minimum of 1 yr, unless otherwise noted.
The Secretary of State will immediately revoke the driving privileges of someone convicted of a moving violation that caused a crash and resulted in the dealth of another person.
The Secretary of Sate’s office has the authority to _revoke the driver’s license of a repeated traffic offende_r.
During the course of any revocation, your vehicle registration may be suspended.
Offenses that result in Revocation
- Aggravated DUI
- Aggravated Fleeing Police
- Aggravated Reckless Driving
- Auto Theft
- Drag Racing/Street Racing
- Felony Offnses - A vehicle was used while commiting a serious crime
- Fradulent ID
- Gang-related Activity
- Leave the Scene
- Perjury - giving false information to the Secretary of State
- Reckless Conduct
- Reckless Driving
- Reckless Homicide
Reckless Conduct - reckless behavior - causing injury or danger to another person
Reckless Driving - conviction of 3 reckless driving offenses in 12 months — causing great bodily harm, permanent disability/disfigurement to another person
Reckless Homicide - reckless driving causing death of another person
Suspension - a temporary loss of driving privileges
When the suspension is for a specific length of time, you may regain your driving privileges after your suspesion has ended and you have paid a reinstatement fee.
Offenses that result in Suspension
- Automated Traffic Violations - failure to satisfy 5 or more unpaid automated traffic violations (red light signal, speeding, a combination of both)
- Causing a Crash in a Construction Zone
- Child Visitation Abuse
- Drug/Alcohol Test Failure
- Drug/Alcohol Test Refusal
- Drug/Sex Offense (Commiting a drug/sex crime while operating or being near automobile)
- Failure to Appear Violations
- Failure to Obey a Railroad-Crossing Signal
- Failure to Pay Child Support
- Failure to Yield to an Emergency Vehicle Using Audible and Visual Signals (lights and sirens)
- Fradulent Driver’s License/ID Application
- Illegal Possession, Consumption, Purchase of Alcohol, or Accepting Alcohol as a Gift by a person under age 21
- Illegal Trasportation of Alcohol
- Illegal Transportation Under 21
- Mandatory Insurance Violation - Failure to file Financial Responsibility Insurance (SR-22)
- Mandatory Insurance Conviction - driving without mandatory insurance
- Parking Violations - Failure to pay 10 or more unpaid parking violations in any municipality
- Railroad Crossing Violation - nonpayment of 5 or more violations
- School Bus Violations - not for stopping for school bus, nonpayment of 5 or more violations
- Speeding in a Construction Zone - 2nd violation, when workers are present, within 2 yrs
- Theoft of Motor Fuel
- Tollway Violation - nonpayment of 5 or more toll violations
- Traffic Crashes - refusal or neglect to report a traffic crash
- Traffic Violations - 3 traffic violation conviction during a 12 month period (Under age 21, 2 traffic violations within any 24-month period)
- Unauthorized Parking in a Space Designated for Persons with Disabilities
- Uninsured Crashes - being uninsured at the time of crash - you are at fault and you are to pay for damages
- Zero Tolerance Violation - an alchocol violation by a person under age 21
Driving while your license is suspended or revoked will result in an extension of the suspension or revocation period
and
may subject you to a period of incarceration.
Cancellation - termination by formal action of the Secret of State’s Office
Reasons for Cancellations
- error or deficit in the license
- Ineligible - the licensee is no longer entitled to such license
- Medical condition - medically/visually unfit
- Re-examination requirement - failure to appear for a required re-examination
- Fraudulent application
Reapplication for a driver’s licese many be made only after the terms of the cancellation have been met.
Denial - the temporary refusal of the privilege of applying for a driver’s license and/or an instruction permit.
Only denial for persons under age 18 is to be entered on the driving record for the following offenses
- Mandatory revocation of driving priviliges for offenses listed on page 52
- Driving with no valid license
- Serious moving violation
- Crash involving Bodily harm or Death
Special Driving Permits
- Restricted Driving Permit (RDP)
- only during certain times and along specified routes for work-related/educational purposes
- transporting a child in the home to and from day care/school
- receive medicare care or drug treatments
- Monitoring Device Driving Permit (MDDP)
- issued to 1st time DUI offender, serving statutory summary suspension
- for Breath Alcohol Ignition Interlock Device (BAIID)
- MDDP & BAIID —> allowing driver to legally operate motor vehicle at any time of day/night
- CANNOT be issued to persons under age 18
- Occupational Driving Permit (ODP)
- issued to professional drivers - whose licenses suspended for 3 moving violations
- allowing to drive in conjuction with employment
- DOES NOT apply to commercial drivers
- Probationary License
- issued in conjuction with driver improvement activity
- issued for suspension period for drivers ages 21 and over
- Only issued for person suspended for 3 moving violations in 12-month period
- CANNOT be issued for more than 3 months

Family Financial Responsibility Driving Permit (FRP)
1. issued to drivers - suspended under the Family Financial Responsibility Law for nonpayment of child support or for child visitation abuse
