What is C v DPP and where does it apply?
A
- Concerned around criminal responsibility from the age of 10 to 14
- Until this case a child of this age could only be convicted if they knew what they were doing
- The Divisional Court held times has changed and children where more mature and presumed that child of this age knew right form wrong
- Case appealed to House of Lords who overruled the decision and a child of this age could only be convicted if the prosecution could disprove that presumption
- The House of Lords ruling was on the basis that Parliament should make major changes not courts
- This is helpful to show the further appeal to the Supreme Court
