  • In the Crown Court, the judge wrongly ordered someones detention
  • The person started a claim against the judge for false imprisonment
  • The Court of Appeal held that whilst the detention has been unlawful, no action could be taken against the judge as he acted in goof faith

  • There was a claim to return him to Chile to face trial for claims that occurred when he was head of state
  • Amnesty International granted leave to participate in the case
  • House of Lords ruled him to be extradited, but 1 judge was an unpaid director for Amnesty
  • The case was reheard by independent judges
  • Independence of the judiciary (Independence from case)
