what is Re b (Adult; Refusal of Medical treatment) and what area of law does it apply to?

A
  • A women paralysed from the neck down needed a ventilator to breathe and had no prospect of recovering
  • Made requests for it to be switched off, but doctors refused
  • Went to high court to apply for a declaration that she had the capacity to refuse treatment, the court held that any further treatment would be unlawful
  • This is used in the area where law and morality can be in conflict for the right to die

  • Mr B was a railway worker killed doing maintenance work
  • Regulations say there should be a look out person for the purposes of ‘relaying or repairing’
  • Mrs B claimed compensation but was rejected as Mr B hadn’t been ‘repairing or relaying’
  • Peoples concept of justice isn’t always the same (Law and Justice)
