Accomodate
To meet the individual needs of a certain person in regards to a work, learning or living environment.
Accommodation
A physical entity such as a building or room arrangement that has been altered in order to fit the needs of a certain individual.
Affirmative Action
An action or policy favoring those who tend to suffer from discrimination, (or have suffered from discrimination through out history) in regards to -employment or education, (positive discrimination)
Bona fide occupational requirement
A required skill set or knowledge in order to perform a certain job. A Bono fide occupational requirement can be used as an expectable form of discrimination.
Complainant
The person who is filling a complaint in some formal process, (such as court action or filling a complaint with the Human Rights Commission).
Conciliation
The action of bringing people together in a friendly manner in order to resolve conflict, (with out going to court).
Constructive discrimination
Constructive discrimination is the act of setting guidelines or regulations in a certain job or organization that indirectly discriminates against certain people. Ex: people are unable to where crosses in the mall but no other religious symbols are banned.
Direct discrimination
When a person is treated differently based on race, gender, or other characteristic. Ex, an employer who refuses to hire any women is direct discrimination.
Discrimination
The act of treating a certain person or group of people differently because of that persons differences.
Facilities
A space or equipment necessary for doing something. Ex: School, or a bank.
Gravamen
The most serious or central part of an accusation.
Harassment
The act of continuously annoying or slandering, or making a person uncomfortable or harming a person in someway. Ex: a boss in the work place continues to make daily remarks slandering a employee’s sexual orientation.
Human Rights
The basic liberties, freedoms and rights that every human being is entitled to.
Human rights codes
Laws that are given to all canadian citizens, that ensure our Human Rights be protected by law.
Mediation
The process of assisting the people in a dispute
in order to resolve it or negotiate a solution
that satisfies all of them, (without going into court).
Poisoned Environment
A poisoned environment occurs when a person feels unsafe, or uncomfortable with a certain work or living space, do to a form of harassment that takes place. Ex: if a certain person is constantly harassed at a work place, than that person may dread coming to work every day, and so this would be a poisoned environment.
Prejudice
The act of forming a preconceived judgment on a person or group of people based on stereotypes.
Prima Facie
A legal argument that looks convincing or sound at first glance.
Respondent
The person named in a legal action who responds to a court application, petition, or appeal filed against them. Ex The person who is harassing someone and is complained against is the respondent.
Sexual Harassment
harassment in a workplace, or other professional or social situation, involving the making of unwanted sexual advances or obscene remarks. Ex: a boss continuously asks an employee out on a date after she has said no.
Stereotyping
A widely held but fixed and oversimplified image or idea of a particular group of people or item.
Undue Hardship
Undue hardship is an expectable form of discrimination where an employer proves that it would be finically unwise and or too strenuous to make an accommodation for a certain individual in order to work in such work environment. If an employer can prove undue hardship than it is acceptable to not to hire a certain person on the bases of there accommodation needs.
