Professional Liability
a tort of negligence for professionals that protects them from economic loss in the event that their client suffers from injury due to the service they have provided
fiduciary duty
a standard by which professionals have a legal responsibility to their client to provide a service or advice in the best interest of their client without personal gain
Consumer Product
means a product, including its components, parts, or accessories, that may reasonably be expected to be obtained by an individual to be used for non-commercial purposes, including for domestic, recreational and sports purposes, and includes it’s packaging.
Occupier
a person, persons or organization that may be the owner, landlord, tenant or anyone who has responsibility, dictates the activities, and decides who enters the property
Contributory Neglidence
where the court apportions responsibility to the injured
Trespasser
a person, persons or organization that enters the land of the occupier without legal right or permission
Licensee
a person, persons or organization that enters the land of the occupier with permission
Invitee
a person, persons or organization that enters the land of the occupier with an invitation so that the occupier benefits from the invitee’s business
