Scope Of Practice
Was the EMT allowed by law to do what he did?
Standard of Care
(1) Did the EMT provide the right assessment and emergency care for the patient? (2) Did the EMT perform the assessment and emergency care properly?
Duty to Act
While on Duty you have to care for the patient who consents, if off duty, you can be seen as a citizen but some states still force you to aid in help in some way.
Good Samaritan Law
Protects a person who is not being paid for his services from liability for acts performed in good faith unless those acts constitute gross negligence.
Expressed Consent
Verbal or non-verbal agreement.
Implied Consent
Unconscious person or someone who is mentally unstable from the incident.
Minor Consent
A parent, guardian, teacher, can give consent, if the child in emancipated, the don’t need minor consent.
Involuntary Consent
When someone is in custody or mentally unstable and needs a caretaker to give consent.
Advance Directive
Instructions written in advance
Do Not Resuscitate (DNR) Order
Legal document that orders to resuscitation of the Pt.
Living Will
What treatment the Pt. will have done when they are unconscious or mentally incompetent.
Durable Power If Attorney
Someone who can make health care decisions.
Physician Orders For Life-Sustaining Treatment (POLST)
A person who had around a year or less left to live, are given more freedom on what they want to have done medical wise.
