What does section 19 S&S allow?
A constable may search any person found in or on a place or vehicle in relation to which a search warrant is issued under section 6. If the offence is against the misuse of drugs act.
What does section 20 S&S allow?
A constable may enter and search a place or vehicle without warrant if they believe on reasonable grounds;
•it is not practical to obtain a warrant and that in that place or vehicle there is;
•a controlled drug.
What does section 21 S&S allow?
A constable conducting a search of a place or vehicle under section 20 may without a warrant search any person found in or on the place or vehicle.
What does section 22 S&S allow?
If a constable has reasonable grounds to believe a person is in possession of a controlled drug they may search the person without a warrant.
What does section 23 S&S allow?
An internal search of a person under arrest.
Circumstances for requiring internal search?
The suspect is arrested for an offence against section;
6: dealing with controlled drugs
7: possession and use of controlled drug
11: theft etc of controlled drug and there are grounds to believe they have hidden evidence within their body
Who may conduct an internal search?
A registered medical practitioner.
