Negligence
He failure to use ordinary or resonance care that a person should normally excessive to avoid injury to themselves or to others
Standard of reasonable care
Assumed that an individual in neither exceptionally skillful nor extraordinarily cautious, but it is a person of reasonable and ordinary prudence
Duty of care
Exists between the person injured and the person responsible for that injury
Torts
Legal wrongs committed against the person or property of another
Act Of omission (nonfeasance)
The individual fails to perform a legal duty
Act of commission (malfeasance)
He or she commits an act that is not legally his or hers to perform.
Misfeasance
An individual improperly does something that they have the legal right to do
Negligence
Alleged when an individual does something that a reasonably prudent person would not do, or fails to do something that reasonably prudent person would do.
Good Samaritan law
Provides limited protection against legal liability to any individual who voluntarily chooses to provide first aid, should something go wrong
Assumption of a risk
When an athlete knows of and understands the dangers of an activity, and voluntarily chooses to be exposed to those dangers
Product liability
Refers to the liability of any or all parties along the chain of manufacture of any product for damage caused by that product
NOCSAE
The national operating committee on standards for athletic equipment establishes minimum standards for equipment that must be met to ensure safety
Managed care
Cost of a health care providers medical care are closely monitored and scrutinized by insurance carriers
Medical insurance
A contract between an insurance company and a policyholder in which the insurance company agrees to reimburse a portion of the total medical bill after some deductible has been laid by the policyholder
Secondary insurance
Coverage that pays the athletes remaining medical bills once the athletes personal insurance company has made its payment
