  • power under S.93(3) is limited to correctible clerical or minor error which cause no prejudice to judgment debtor.
  • amendment to remove name is not permissible, i.e. it would change the character of the BN & cause prejudice to the JD.

  • It only allows substitution of a petitioner or providing the DGI carriage of proceedings where the petitioner does not proceed with due diligence & obtain BO.
  • S.95 does not apply when co-petitioner who had received his portion of judgment but later wished to cease from being a party in the proceedings.
