The People’s Participation in the Government Consist of 3ways:
- S uffrage
- P lebiscite
- i nitiative & Referendum
Legislative Power
- Power to p.e.a.r
p-ropose, e-nact, a-mend, and r-epeal laws. - Vested in the Congress, except to the extent reserved to the people by the provisions on Initiative & Referendum
Initiative
Power of the people to propose Amendments to the constitution or to propose & enact legislation through an election called for the purpose.
REFERENDUM
Power of the electorate to approve or reject legislation through an election called for that purpose.
3 classes of initiative:
1 initiative on the Constitution
2 initiative on Statutes
3 initiative on Local Legislation
2 classes of referendum:
1 statutes
2 referendum on Local Laws
1 SENATE
24, elected at large (national) by the qualified voters of the Phils.
Qualifications to become a Senator:
A. N-atural born citizen of the Phils.
B. O-n the day of the election, is at least 35yo,
C. A-ble to read & write
D. R-eg-istered voter
E. R-es-ident of the Phils. for not less than 2yrs immediately preceeding the day of the election
- HOUSE OF REPRESENTATIVES
Not more than 250 members consisting of:
A. District representatives
B. Party-list representatives
A. District representatives
Elected from legislative districts appointed among the provinces, cities and the Metropolitan Manila area.
B. Party-list representatives
Shall constitute 20% of the total # of representatives elected through a party list system of Registered National, Regional & Sectoral parties or organizations.
Qualifications of a Member of the House of Representatives:
A. N-atural born citizen of the Phils.
B. O-n the day of the election, is at least 25yo,
C. A-ble to read & write
D. R-eg-istered voter in the district in which he shall be elected (except the party-list representatives)
E. R-es-ident of the Phils. for not less than 1yr immediately preceeding the day of the election
Apportionment of Legislative District shall be made in accordance with the number of respective inhabitants on the basis of a Uniform & Progressive Ratio, BUT:
A. EACH CITY with <250k inhabitants, entitled to at least 1 representative;
B. EACH PROVINCE, irrespective to the number of inhabitants, entitled to at least 1 representative.
Gerrymandering
Formation of 1 legislative district out of separate territories for the purpose of favoring a candidate or a party.
Regular ELECTION
2nd Monday of May, every 3 yrs. For the Senate, half of the membership is elected every 3yrs on even date.
