What are the responsibilities of the Lead vehicle Driver?

- Continually assess (TENR)
- Lights & siren activated
- Direct officer to undertake comms (where 2 up)
- Advise Comms: location, direction, description, reason
- Acknowledge pursuit warning from comms

- Comply with Pursuit Controller

What is the overarching principle in regards to fleeing drivers?
Public and police safety takes precedence over the immediate apprehension of fleeing driver.
What are the key points to managing a pursuit?

- Fleeing driver must be managed in safest possible manner
- Inquiry phase preferred over pursuit
- pursuits commenced continued only when necessitated by seriousness or necessity
- fleeing driver does not in itself justify pursuit
- decisions to abandon will be supported
- TENR and flexible response to be used
- Fleeing drivers held to account
What is the abandonment procedure for the pursuing patrol?

- Acknowledge direction to abandon or advise Comms that pursuit is being abandoned
- Reduce speed to Increase distance
- Deactivate warning lights
- Stop when safe
- Confirm with Comms you are stationary
- inquiry phase or tactical option to commence
What powers exist to stop a vehicle?
- s.114 LTA1998: For traffic enforcement purposes
- s.9 SSA 2012: to arrest person
- Persons unlawfully at large/ is in the car/has committed an imprisonable offence
- s.121 SSA 2012 search vehicle
- Without a warrant if satisfied grounds to search with warrant and it is in force
- With a warrant if satisgied warrant issued and in force
Police constabulary passenger responsibilities
- Radio Comms if in lead vehicle
- Advise lead driver of risks/other considerations
- May direct lead driver to abandon
- Pursuit controller must be notified when safe
- Reason for abandonment
Secondary vehicle responsibilities
- Follows behind the lead vehicle at a safe distance, to provide support and tactical options as required.
- Takes over the pursuit commentary, if the lead vehicle is single-crewed.
- May direct abandon
- notify the Pursuit Controller, when safe to do so,
- including the reason for abandonment.
Other Police vehicles in vicinity or responding as a requested tactical option
- Must not actively participate - unless preparing tactical options, undertaking a temporary road closure, collecting intelligence or are responding to a Pursuit Controller direction that could assist in safely stopping the fleeing driver.
- Notify location, tactical option and seek permission as appropriate, when safe to do so, if self-initiating a tactical option
- Must cease all non-essential radio communication.
- Must not follow behind pursuit unless directed or approved to do so by controller
- Must comply with the ‘Urgent Duty Driving’ chapter and direction from the Pursuit Controller.
Abandon
Permanently abandon the fleeing driver pursuit. No further attempt to signal the vehicle to stop will be made unless the Pursuit Controller gives prior approval
District reviewer
Nominated by the District Commander to review pursuits in their district
Field supervisor
The field supervisor overseeing the inccident - this may be different to the pursuing officers line supervisor.
Fleeing driver
A driver who has been signalled to stop by a constable but fails to do so.
Police constabulary passenger
A constable who is a passenger in the lead or secondary vehicle.
