Interview :
Conducted for the purposes of gathering information from people who have or may have knowledge needed in the investigation. It is a planned conversation with a specific goal.
Elements common to both forms of obtaining info :
- Establishing rapport
- Asking good questions
- Listening carefully
- keeping proper documentation
Interrogation :
Designed to match info to a particular suspect in order to secure a confession. It is the process of testing that info and its application to a particular suspect.
Four commonly recognized objectives in the interrogation process :
- To obtain valuable facts
- To eliminate the innocent
- Identify the guilty
- To obtain a confession
Once witnesses are located :
They should separated from one another and as mush as possible, isolated from the people who maybe loitering in the area.
Most important factor while conducting an interview :
Privacy
Most unreliable form of evidence :
Research indicates that EYE WITNESS TESTIMONY is the most unreliable form of evidence and causes more miscarriages of justice than any other method of proof.
Best form of documentation :
Electronic sound recording or sound/visual recording.
Documenting an interrogation consists of three main phases :
Note taking, recording, obtaining written statements.
False statement :
Admission of guilt followed by a narrative statement of what, how, and why the confessor committed the crime.
3 types of false confessions :
- Voluntary
- Coerced-complaint
- Coerced-internalized
Miranda V. Arizona :
Supreme court decision that spelled out requirements and procedures to be followed by officers when conducting an in custody interrogation of a suspect.
Custody -
Occurs when a person is deprived of his/her freedom in any significant way or is not free to leave the presence of law enforcement.
