Decision making ability for things that influence a person’s life
How to assess capacity?
Decision specific not disease specific (Not all people with mental disorder lack capacity)
What must a patient do to be able to give consent for treatment?
Understand what treatment is and purpose
Understand benefits, risk and alternatives
Understand consequences of not having treatment
Retain info long enough to weigh it up and decide
When was the adults with incapacity act passed

What is a power of attorney?
Authority given by an individual (granter) with capacity to another person (Attorney) to deal with aspects of the granters affairs
What is welfare/financial guardianship?
An intervention order authorising a person to take action or make decisions of which the adult is incapable
What age in Scotland are you assumed to have consent, an when may this not be the case?

Certificate of incapacity under section 47 of incapacity act 2000
What does section 47 prohibit?
The use of force and detention, unless it is immediately necessary and only for as long as is necessary
