Criminal Attempts Act
Under s1(1) attempt = an act which is more than merely preparatory to the commission of the act
R v Campbell
Plan to rob a post office, was arrested before he entered the post office, possessed imitation gun and threatening note. Had not embarked on the crime proper.
Davey v Lee
There was a hole in a fence through which the defendants had attempted to steal metal, was more than merely preparatory act
When is an attempt not an attempt?
Summary only offences, conspiracy to commit an indictable offence, aiding, abetting, counselling, procuring or suborning the commission of the offence, encouraging or assisting suicide or some acts under the Criminal Law Act 1967, also low value shoplifting (summary only due to value)
