Civil Liberties
Constitutionally protected freedoms of all persons against government restraint
Civil Rights
Constitutional rights of all people, not just citizens, to due process and the equal protection of the laws
Symbolic Speech
nonverbal forms of communication, such as flag burning, wearing armbands and burning of draft cards.
Protected Speech
right to express oneself and their views in spoken words, actions, printed materials, assemblies or gatherings and petitions submitted to the gov.
Defamatory Speech
The verbal expression of false/malicious statements that damage someone’s reputation.
Selective incorp
a doctrine describing the ability of the federal gov to prevent states from enacting laws that violate some of the basic constitutional rights of American citizens.
Due Process
The Due Process Clause of the 14th Amendment provides a constitutional basis for the protection of indiv. rights against government intrusion
Equal Protection
A clause of the 14th amendment protects against discrimination based on demographic factors from states who deny equal protection of the laws to any person within its jurisdiction
Exclusionary Rule
Requirement that evidence unconstitutionally or illegally obtained be excluded from a criminal trial
Miranda Rule
A requirement that law enforcement officers inform a person subject to an interrogation of their right not to incriminate themselves under the 5th and 6th Amendments
Establishment Clause
Prohibits the government from establishing a region.
Free Exercise
Clause in the 1st Amendment that states that Congress shall make no law prohibiting the free exercise of religion.
Prior Restraint
A form of censorship that allows the gov to review the content of printed materials and prevent their publication.
Rights of the accused
the accused has the right to receive a lawyer to confront any witnesses brought against them. They have a right to have a “speedy trial” with fair jurors.
