1st Amendment
reglion, assembly, petition, press, speech
Limits of assembly
has to be peaceful, have to have a permit
2nd Amendment
guns
3rd Amendment
housing troops not allowed
Propable Cause:
protects us from the government interfering with out rights without a good and fair reason (balance of security v rights)
4th Amendment
protects against unreasonable searches and seizures
gov can’t search without a warrent & probable cause unless u let them (warrent - doc that states what’s gonna be searched)
Exclusionary Rule:
evidence obtained without a warrent (therefore illegally) cannot be used in court
5th Amendment
Due Process, right against self incrimination (giving urself away), Double Jeopardy, Miranda Rights, Eminent Domain, “plead the 5th”
6th Amendment
- right to a fair and speedy trial
- must be told what crime you’re being accused of to confront and be confronted by a witness
- right to an impartial, unbias jury
- right to a lawyer/attorney/counsel - even if u can’t afford it
7th Amendment
right to a trial by jury in all civil cases
Civil cases - trials with other citizens usually for money, not with the gov and not criminal cases
8th Amendment
- no one should suffer excessive bail and punishment
- punishment should fit the crime
- no cruel and unusual punishments
9th Amendment
- legacy of the federalists
- powers not specificially listed are given to the people
10th Amendment
- State’s rights
- powers not given to the federal gov, goes to the state gov
(ex: education, licenses)
