How is CAA initiated?
Initiated by Introducing the Bill
Who can introduce a bill?
Any private member or a Minister
Does introducing a bill require President’s prior permission?
No
Bill should be passed in which house and with which majority?
- RS and LS
- Depends on the case such as Simple Majority, Special Majority, (or) Special Majority + State’s Ratification (If required)
Disagreement of one house leads to cancellation of process, any remedies for it?
No, there is no provision of joint sitting of two houses
After passing of bill with special majority what is the next step? (Think within the houses)
Each house should ratify with a majority of total membership (i.e. at least 50% of total strength)
Bill passed from both the houses then?
President can neither withhold nor return back for improvements, He/she has to assent the bill then it becomes a CAA
Types of amendments of the constitution
- Simple Majority
Changes made to the constitution not affecting the people or states directly - Special Majority
Changes made to the FRs, DPSPs, and others not include in (1), (3) - Special Majority with States ratification
Such as:
- Changes to SC and HC
- Changes to GST Council
- Changes to any list in Schedule - VII
- Changes to A368
