What are the exceptions to commercial pesticide application certification?
- application is conducted by employee as part of their work assignment
- the employer does not engage in commercial, custom, or contract use of pesticides
- application is conducted on the employer’s property ONLY
- the product is a general-use pesticide
- application area is not a public place
Requirements that commercial applicators must meet
- be certified, or directly supervised by a certified applicator
- detailed records must be kept of each application
- proof of liability insurance
- pesticides must be stored correctly in a locked storage area, and warning signs must be posted on the outside of the storage area
What information must be recorded when pesticides are applied commercially?
- pesticide product name
- EPA registration number

- site (e.g., front yard, living room, etc. or specific crop to which pesticide was applied)
- size of area treated
- application rate (temp and duration for fumigants)
- dilution of pesticide
- total amount of pesticide applied (lbs released for fumigants)
- target pests
- name of applicator
- cert number of applicator
- copy of instructions provided to a pesticide tech (as relevant)
For restricted-use pesticides (RUPs) -
- name of the person for whom the pesticide is being applied

The three types of areas that are considered a pubic place
- parks, playing fields, and similar areas;
- shared areas of apartment buildings such as hallways, laundry rooms, parking areas, or garden/lawn areas. This definition applies to buildings that contain five+ single-family residences;
- public areas of governmental facilities
How long must pesticide application records be kept? When must they be provided to DEC?
- up to 2 years
