aims to protect people who lack capacity to make decisions and support their involvement in making decisions
Principles of Adults with incapcity act

Capable of making and communicating a chocie

aware of alterantives and risks and benefits
aware of personal revlevance to them
not under influence from anyone
Who can you consult if a person has incapcity
nearest relative and primary of care adult
any guardian, continuing attorney or welfare attorney
any person who the sheriff decides
medical and dental practioners under seciton 47 pf AWI act
Certificates of incapacity
given to someone who lacks capacity
issued by - medically practioner primarily responsible for patient care, consultant in change of the patients care, registred nurses, optometrists, dental practioners (if specalised)
Power of attorney
granted by adult when they still have capacity
certified by a lawyer or medical practioner (proxy)
Welfare power
powers only come into effect when person is incapable of decision making
Matters relating to health and personal
Must be registered with the off of the public guardian
Continuing power
only covers finicial affiars, properties
Guardianship oders (if joint guardainship just required from 1)
Court appointed
requires 2 medical reports
powere to deal with property, finance, martial affairs
appointed for 3 years
Person has NO CAPACITY
