advantages of using ADR
- less formal
- lawyers not encouraged
-quicker than court - not all legally binding
disadvantages of ADR
-parties not forced to engage in process
-usually lower compensation than in court
-no funding for claimants
- employment tribunals can be intimidating
advantages of employment tribunals
-can be straightforward no contact between parties
-low or no cost / no need for lawyers
-parties themselves in controll
-relationship between parties are conserved
-continued business relationship
disadvantages of employment tribunals
-parties may be hostile towards eachother
-one party may not be ready to negotiate with the other
-either party may believe they are right and not be ready to settle
-may only be resolvable by court
advantages of negotiation
-cheaper than court
-parties have some power over choosing conciliator
-future business relationships may be preserved
disadvantages of negotiation
-conciliator may for a resolution on one of both of the parties
-process may not bring a resolution
-result may not be binding
