Must have relevant mens rea when performing act.
Can be guilty of manslaughter if evidence that medical episode was cause of def actions eg in burg. d/not need to be specific evidence
Causation must be operative and substantial but not necessarily a direct cause of result.
Intervening Acts must be free. deliberate and informed.
Burglars making off in stolen car deliberately drive at and kill IP. Guilty manslaughter by joint enterprise as offence of burglary committed as per common goal. Both could foresee mens rea of other commiting another offence, eg murder.
Companies can be guilty of offences as a result of their employees even sexual offences (aid/abet etc)
Procurement must show a causal link bt conduct and offence
Counsel requires NO causal link
MURDER by joint enterprise - gangs. guilty if another gang member carries knife and def knows they may use it.
AID - help, support, assistance
ABET - incite, instigate, encourage
usually involve presence of secondary party at scene to
COUNSEL - advise/instruct
PROCURE - bring out
Usually take place b4 commission of offence.
