What is the funding in civil cases?

A

Funds are extremely limited, usually only available for some family cases. There income must be below the set limits.

A

Gross income = below £2,657 pm
Disposable income = below £733
Disposable capital = below £8,000

What are the two advice schemes in criminal cases?

A

1- Duty solicitors, free advice for anyone held at a police station.
2- Advice and assistance, solicitor for a legal aid agency . Only for those on low incomes and its only advice.

How to qualify for legal aid (criminal)?

A

1- Means test, theres a strict financial criteria as they are usually petty crimes so not really necessary although at crown its not as hard to qualify.
2- Interest of justice, must show its in interest of justice by:
A) would lose livelihood
B) point of law
C) can’t understand proceeding
D) Interest of another person

What are conditional fee agreements?

A

Can be used in civil cases, client agrees a fee with solicitors but they only have to pay if they win. Also must pay a success fee.

What is the citizens advice bureaux?

A

A charity organisation, which gives free advice on a variety of issues. Usually work with a solicitors firm.

A

Give free legal advice to people in their areas, they specialise in social welfare and are funded by the government.
