Explain how repeat offenders/recidivism are a limitation in achieving social control

A

Recidivism is one of the reasons that prison population has dramatically increased over the last 20 years. Acording to the Prison Reform Trust, between 1995 and 2015 the prison population in England and Wales nearly doubled, with an extra 4000 people behind bars. In addition, the Bromley breifings factfile shows that nearly 46% of adults are reconvicted within one year of their release, this is proven to limit social control

Explain how civil liberties and legal barristers are a limitation in achieving social control

A

Civil liberties can limit social control as people have the right to freedoms of speech, freedom of movement etc which can be seen as a restriction on agencies such as the police in achieving social control. The case of Abu Qatada is a clear demonstration of how civil liberties are a limitation. In this case, he could not be deported back to Jordan because of the risk he would be tried on evidence detained by torture. Marxists would argue that the working class need the liberties to be protected from the upper class

The Bromley breifings factfile states that 51% of people entering prison were assessed as having literacy skills expected of an 11 year old. no resources to rehabilitate = 3/4 prisons inadequate sources to build skills

Explain how repeat finance is a limitation in achieving social control

A

Finance has a limitation in achieving social control as public fector funding is inevitably limited and cuts in budgets will impact on the effectiveness of agencies providing social control. According to the House of Commons breifings funding paper, the central grant to policr forces has decreased by 25%. This has had a large impact on prisons such as at HMP the mount 2016, in this case prisoners armed with weapons seized control of nash wing and many escaped. In addition, staff cuts at the CPS have led to a marked decline in its performance with inadequate case progression. Clearly, this could lead to misscariages of justice and therefore decreases the effectiveness of social control.

A

Local police forces prioritise certain crimes in preference to others. Inevitably, this would mean certain crimes are not investigated. For example there have been allegations that the police prioritise “trivial crimes” instead of serious crimes

Explain how environment can be a limitation in achieving social control

A

Very often, when offenders are released from prison they return to the same social circle which will make them more likely to take part in anti social behaviour such as drug taking or reoffending as a whole. According to the prison reform trust, people are less likely yo reoffend if they live with their immediate family upon release. In addition, finding employment upon release can be extremely difficult and has a massive impact in effective social control as it is a likely reason why offenders reoffend. Only 12% of employers surveyed said that they had employed someone with a criminal record. Therefore, as criminals find it so difficult to find a job, it is likely that they will turn to illegal methods of making money.

Explain how crimes commited by those with moral imperetives can effect social control
.

A

A moral imperative is a strongly felt principle that compels a person to act. Assisted suicide could be argued to be a crime with a compassionate motive as the offender feels they are doing the right thing. Such as in the case of Kay Gilderdale who administered drugs to her daughter in order to help her die as she felt that it was morally the right thing to do. In this case, the jury indicated strong sympathy for her case and therefore she was acquitted of the attempted murder of her daughter Lynn and given a conditional discharge for assisting her suicide. However, this case can be compared to a similar cases where the jury have not been as sympathetic and the sentence was much harsher which makes it confusing to society
