A

Homosexuality changes in cultures because it is illegal in 72 countries and in 45 countries lesbian relationships are illegal. The reasons why are religion because many Christianity, Islamic countries condemn homosexuality as illegal. The other reason is public opinion because some bands are supported by public opinion.

How does cannabis change within cultures?

A

Cannabis changes in different societies. In the UK possession of cannabis can be punished for up to 5 years however in countries like Portugal they have decriminalised the possession for personal use or other. The reason for this is different norms and values because societies with a greater emphasison individual freedoms may see drug use as victimless.

Drug laws change overtime because in Portugal in 2001 possession and usage became decriminalised because the drug usage was so high in Portugal reasons why are because of public health and opinion.

A

Childhood is a very good example of social construction. Philip Aries argues that until the 13th century childhood does not exist. It changed over time because of children’s rights, compulsory schooling and laws and policies that only now apply to children such as minimum age is for a wide range of activities from sex to smoking.

How did laws concerning physical punishment change over time?

A

Physical punishment changed over time because of capital punishment which is the execution by hanging was abolished in 1965. Corporal punishment which has included flogging and canning with with branding hot irons has been abolished. Capital punishment is now regarded as a breach of the most human basic right. It changed over time because nothing can be done to correct a miscarriage of justice. The death penalty was not viewed as a deterrent for most murders and some writers say that the changes were due to a long-term decline in violence over societies.

What did these three special defences mean?

A

The minister responsibility means if they can show their mental condition subtly reduce their judgement. This reduces the conviction, lots of control is a partial defence that may reduce the offence to manslaughter. Automatism is if a crime was an involuntary act. The defendant must have consciously chosen to commit the crime if they can prove it was involuntary they complete this defence.
