AC 2.2- Aims of punishment Flashcards
What are the 5 aims of punishment?
-Retribution
-Rehabilitation
-Reparation
-Protection of public
-Deterrence
Define Retribution.
Linked to being punished by society, if you’ve broken societal norms there should be a form of sanction.
Evaluate Retribution.
+Good for the victims as they get justice.
-Might encourage people to offend.
Define Rehabilitation.
Getting someone to change their behaviour that causes them to offend.
Evaluate Rehabilitation.
+Reduces offending and violence in prison as well as in the real world.
-Might not have long term effects, people will still reoffend.
Define deterrence.
To put off a certain behaviour.
Two types:
1) Individual= to deter an individual from offending.
2) General= to deter society from committing crimes.
Evaluate deterrence.
+Is effective in preventing crime.
-Some punishments may be too harsh for the crime committed.
Define public protection.
Aims to protect the public and victims and this is the priority. They believe the offenders should only be punished and not, for example, rehabilitated.
Evaluate public protection.
+Protects victims of crime and ensures them justice.
-May give innocent suspects really harsh punishments, resulting in a miscarriage of justice.
Define reparation.
The offender should make amends (repair the damage) for a wrong they have done, either to the victim or society as a whole.
Evaluate reparation.
+Benefits society as the offenders may do unpaid work.
-Doesn’t stop them from reoffending, not long term effects.
