How many Drs are required to authorise an abortion?
2 - both agreeing the abortion meets required grounds
What makes an abortion legal under the abortion act?
- Performed by a dr (or medical team under guidance of dr)
- Authorised by 2 drs
- Not exceeding 24th week
- On one (or more of the these grounds):
- continuing would involve greater risk to physical or mental health or woman, her children or family
- necessary to prevent grave permanent injury to physical or mental health of the woman
- substantial risk the child would be born with serious physical or mental abnormalities
Can a Dr refuse to perform abortions?
Yes. Drs can conscientiously object to perform abortions except where it is needed to save a woman’s life.
Can social circumstances warrant ground for abortion?
Yes. Income, housing and support network may factor into Drs decision to approve abortion.
Can a young person (16-17) consent to abortion?
Yes. 16 & 17 year olds can be presumed capable to consent to treatment.
Can a spouse/partner stop an abortion?
No. Decision rests with the woman and her Drs.
(Paton vs BPAS - went all the way to European court of human rights trying to stop wife getting abortion but was unsuccessful)
