Bidding documents include
Bidding requirements and the proposed contract documents

Bidding requirements consist of
The advertisement or invitation to bid, Instructions to Bidders, supplementary instructions to bidders, the bid form, and any other bidding forms

Proper contract documents consist of
The unexecuted form of Agreement between the Owne and contractor and that agreements exhibits, Conditions of the Contract (general, supplementary, and other conditions), Drawings, Specifications, all addenda, and all other documents enumerated in Article 8

By submitting a bid, the bidder represents that
They have read and understand the bidding documents
They understand how the bidding documents relate to other portions of the project being bid concurrently or presently under construction
The bid complies with the bidding documents
They have visited the site, become familiar with local conditions, and correlated the observations with the requirements of the proposed contract documents
The bid is based upon the materials, equipment, and systems required by the bidding documents
They read and understand the provisions for liquidated dameges

Distribution
Where to pick up the documents and the deposit sum
Deposit sum refunded to Bidders who submit dona fide bid and return documents within 10 days after receipt of bids
Bidding documents not issued to sub bidders
Shall use complete documents in preparing bids
Documents only for bidding, not licensed

Modification or interpretation
Bidders should study the bidding documents and examine the site and local conditions; notify the architect if any errors
Requests for clarification or interpretation shall be submitted in writing at least 7 days before the date for receipt of bids
Modifications and interpretation shall be made by addendum

Substitutions
Substitutions should match functions, appearance, dimension, and quality of original material
Written requests for substitutions shall be received at least 10 days prior to the date for receipt of bids
Shall use Substitution Request Form if provided in bidding documents
If not provided: name of material or equipment in bidding documents, the reason for the request, complete description of the substitution (name, performance and test date, Relevant drawings), other info, and impact on the rest of the work
Architects decision on the substitution is final
Approvals shall be set forth in an addendum
No substitutions will be considered after contract award

Addenda
Addenda sent to all bidders known to have complete bidding documents
They will be available where bidding documents are available
Will be issued no later that 4 days prior to the date for receipt of bids
Bidder shall ascertsin that they have received all addenda and acknowledge it before submitting bid

Preparation of bids
Use the forms included in bidding documents
All blanks legibly executed and paper form non erasable
Sums expressed in words and numbers, words will govern
Edits on paper bid forms must be initialed
All requested alternates shall be bid
Bidder can say they must be accepted for both portions, if applicable
Bidder legal name and entity must be included
Bidder shall incur all costs associated with the protection of the bid

Bid security
Bid shall be accompanied by bid security
Pledges to enter into contract with the owner on the terms stated in the bid and will furnish bond if required
A310 shall be used if surety bond is required
If no contract has been awarded a bidder may withdraw it’s bid and request the return of it’s bid security and certain number of days after the opening of bids

Submission of bids
Paper copies of bids, bid security, and other documents required shall be enclosed in a sealed opaque envelope addressed to the last receiving bids and shall be identified with the project name, the bidders name and address, and the designated petition of the work. Is sent by mail, the envelope shall be enclosed in a separate mailing envelope with “sealed bid enclosed” on the face
Shall be submitted by the date and time and at the place indicated in the invitation to bid
Bid submitted any other way will not be accepted

Bidding procedures
Modification or withdrawal of bids
A bidder may replace a bid or withdraw it completely if prior to the date and time for receipt of bids, shall not reveal amount of original bid
Written bid can be resubmitted in the correct timeframe
Bidders who know of a clerical error shall notify the architect within 2 days requesting withdrawal, which will not be subject to resubmittal

Bid properly identified and received will be publicly opened and read aloud. A Sunday may be available to bidders
