Explain civil liberties.
Civil liberties restrict government power to protect individual rights.
Explain civil rights.
Civil rights require the government to take action to protect individual rights.
Explain the difference between civil rights and civil liberties.
Both are intended to protect individual rights. Civil liberties RESTRICT government action, while civil rights REQUIRE government action.
What is symbolic expression?
An act, rather than speech, that is used to demonstrate/communicate a point of view.
In what way is free speech limited?
Hate speech and fighting words are not allowed. Anything that is deemed dangerous (imminent and likely to occur) is also not included in free speech.
What is prior restraint?
A legal effort to stop speech before it has occurred. It can be described as a form of censorship.
What is exclusionary rule?
The ruling that evidence obtained in an illegal search can’t be used in trial.
What is grand jury?
A jury that decides whether or not there is enough evidence for a case to go on trial.
What is double jeoprady?
An individual can’t go on trial twice for the same crime.
What are the miranda warnings?
A set of rights a police officer must inform to suspects. This includes the right to remain silent.
Explain the sixth amendment.
The 6th amendment guarantees rights to criminal defendants. These rights are the right to a public trial without unnecessary delay, the right to a lawyer, the right to an impartial jury, the right to know your acusers, and what you’re being accused of.
Explain the eighth amendment.
Cruel and unusual punishment shall not be used.
What is the US Patriot Act?
Legislation that brought more national security to the USA following the 9/11 attacks.
