Bail application process

A
  1. Application for bail made by the defendants counsel.
  2. OC should forward instructions regarding bail to prosecutor, regardless if bail is opposed. Provides fall back in case bail is granted.
  3. If bail is to be opposed full detailed reasons for opposing must be given.
  4. Judge will remand the defendant.

Analysis Evidence

A

A certificate of analysis may be produced in Court instead of calling oral evidence in offences concerning controlled drugs (s31 Misuse of Drugs Act 1975).

A
  • in person to the analyst who is to issue the certificate, or to a person authorised by the analyst to receive it
  • by registered post or by courier post with signature required in a sealed package to an employee who has been authorised by the analyst in charge at the laboratory.

Must cross reference
- name of the person who signed the certificate ‘upon receipt of the exhibit’
- receipt signature on the POL 143 form
- evidence of the police member who delivered the drug to the ESR.

Certificate of Analysis (Section 31(3)(a))

  • Must be given within 7 days of hearing
  • Written notice to Defendant that witness will not be called
  • Defendant can reject within 3 days of hearing by writing.
