Two Options for Controlled Deliveries

A
  1. Clean controlled delivery- no drugs are left within the consignment. Eliminates risk of losing drugs, freedom to organize surveillance. Likely only importation or conspiracy charge
  2. Leave amount of drug in consignment, allows for possession for supply charge, also provides emergency powers if drugs move place or person not covered on search warrant

Re-packaging controlled delivery packages, 5 steps:

  1. Liaise with customs technical unit
  2. Consider options for repackaging (tracking device, audio device etc)
  3. Consider seeking advice from the document examiner
  4. Leave appropriate quantity of controlled drugs in package but replace rest with placebo
  5. Photograph package layer by layer

  • SDW Required to intercept Private Comms
  • By law, Police must install (TSU)
  • Audio device must be monitored, even while its mobile.

A

48(2)(e)- suspect offence in relation to controlled drug as per schedule of MODA, or precursor, believe use of SD would obtain evidential material.

48(2)(f) RBTG person is in possession of CD, Precursor, package, EM and believe use of SD is necessary to facilitate the things seizure.

A

Applies to a person under arrest pursuant to sections 6, 7 or 11, MODA and relates to Class A, B and C controlled drugs.

A

deals with person internally concealing drugs. Applies to a person you have RGTB concealing Class A or B controlled drug but who is not under arrest.
