Competency to Stand Trial
A
The legal decision as to whether the person charged with a crime has the capacity to understand the charges against them and the ability to assist their lawyers in preparing a defense. This is not the same as an insanity plea- this is about the person’s state of mind at the time of the trial rather than at the time of the crime. The burden is to prove incompetence rather than proving competence. If the person is found incompetent, they will be treated until they are competent.
